What protections do ASIC-regulated brokers offer?

What protections do ASIC-regulated brokers offer?

What protections do ASIC-regulated brokers offer? Retail leverage caps, a 50% margin close-out, negative-balance protection and segregated client money.

In het kort

ASIC-regulated brokers must give retail CFD clients four core protections: leverage caps (1:30 on major forex down to 1:2 on crypto), a margin close-out at 50% of required margin, negative-balance protection, and segregated client money. They do not protect you from trading losses, and Pepperstone names no compensation scheme for Australian clients, unlike the FSCS cover of its UK company. Pepperstone (AFSL 414530) is our first pick. At Best Trading Signal (BestTradingSignal.com) we rank Capital.com second (AFSL 513393) and XS third, the broker behind our free signals, which holds no ASIC licence.

  • Leverage caps: 1:30 major forex, 1:20 gold and major indices, 1:5 shares, 1:2 crypto
  • Margin close-out: positions are closed when equity falls below 50% of the margin required
  • Negative-balance protection: a retail client cannot lose more than the account holds
  • Segregation: retail money is held apart from the broker's own funds
  • No compensation scheme: Pepperstone names none for Australian clients
  • High risk: Pepperstone's Australian site publishes no loss percentage; the rules limit losses, they do not prevent them

What does an ASIC licence actually protect?

An Australian Financial Services Licence lets a company issue CFDs to Australians, and ASIC's CFD product intervention order then sets extra rules for retail clients. Those rules protect you from a few specific harms: borrowing too much, losing more than your deposit, and losing your money if the broker fails while your funds sit in its own accounts.

They do not protect you from bad trades. ASIC itself says a licence is not an endorsement of a company or its products. Pepperstone Group Limited holds AFSL 414530, and if its protections suit you, you can open a Pepperstone account as a retail client.

What are the ASIC leverage caps for retail CFD traders?

ASIC caps retail leverage by asset class, from 1:30 on major currency pairs down to 1:2 on crypto. Pepperstone's Australian costs table applies these limits, and it lists a few extra categories, such as non-deliverable forex at 1:10.

What is the margin close-out level for Australian retail clients?

50%. Under ASIC's order, a broker must start closing a retail client's positions when the account's net equity falls below 50% of the total margin required for the open positions. If you hold trades that need $1,000 of margin, closing begins once your equity drops under $500.

Close-out is a safety net, not a stop-loss. Positions are closed as market conditions allow, so in a fast move the fill can be worse than the level. Read Pepperstone's Product Disclosure Statement for the exact way it applies the rule.

Do Australian brokers offer negative balance protection?

Yes, for retail clients. ASIC's order limits a broker's claim against a retail client to the money in the CFD account. Pepperstone states it plainly: if your account goes negative, it will restore it to zero.

Professional and wholesale clients are different. Pepperstone gives its pros a one-time negative-balance cover of up to USD 100,000; beyond that, a pro can owe money. That is one of the main reasons to think hard before you give up retail status.

Are client funds segregated at Australian CFD brokers?

Yes. Licensed brokers hold retail client money apart from their own funds, and Pepperstone says it keeps retail funds in segregated accounts at top-tier banks. Segregation protects you if the broker fails, not if a trade goes wrong.

Read Pepperstone's own caveat, too. It says that on a liquidation, segregated money is dealt with under the Corporations Act and that it cannot promise all funds will be returned. Pepperstone names no compensation scheme for Australian clients, unlike its UK company, whose eligible clients are covered by the FSCS.

How do I check a broker holds an AFSL?

Use ASIC's Professional Registers search on asic.gov.au. Enter the company name or AFSL number, open the licensee record, and check four things: the name matches the company in your PDS, the status is current, the conditions cover dealing in derivatives for retail clients, and the website shown on the register matches the site you are using.

What ASIC rules do not cover at Pepperstone

  • No compensation scheme: Pepperstone names none, and warns not all funds may come back on a liquidation.
  • Stops can slip: nothing in the Australian PDS fixes your exit price, so Pepperstone cannot guarantee a stop-loss level.
  • No loss figure: the Australian site publishes no retail loss percentage.
  • Pros lose most of it: wholesale clients give up the caps and get only limited negative-balance cover.
  • Our free signals run on XS, which sits outside ASIC's rules.

Do ASIC protections change how you use Best Trading Signal?

They work well together. Each Best Trading Signal alert includes a stop-loss, which you set yourself, and ASIC's margin close-out sits behind it as a last line. Size each trade from the stop, not from the leverage cap. Pepperstone clients get the alerts through a paid plan on our Telegram bot.

Our free signals need an XS account opened through our link with a $400 deposit, which stays your own trading capital. Because XS holds no ASIC licence, an Australian on that route gives up the protections above. Each closed signal, with its result, is on our performance page. Past results do not guarantee future results, and no signal is certain to win.

What protections matter most when choosing a broker?

Our guide on how to verify a broker's licence walks through the register step by step. If Pepperstone passes your checks, open your Pepperstone account here.

Disclosure: we may earn a commission from Pepperstone, Capital.com and XS if you open an account through our links. That does not change what we publish about them. This page is general education, not personal investment advice.

Risk warning (Pepperstone): Pepperstone's Australian site publishes no loss percentage; read its PDS and Target Market Determination before you trade. Elsewhere, 73.6% of retail investor accounts lose money when trading spread bets and CFDs with this provider under the FCA, 74.1% under CySEC, 76.1% under BaFin, 80% under the SCB and 88% under the CMA (Kenya). You should consider whether you understand how CFDs work and whether you can afford to take the high risk of losing your money.

  • A licence you can verify: an AFSL on ASIC's register, in the exact company name on your documents.
  • Negative-balance protection: so a gap in the market cannot leave you in debt.
  • Segregated client money: at named banks, with the broker's insolvency terms explained.
  • Clear stop-loss terms: know whether your stop can slip.
  • Retail status kept: only give it up with a clear reason.

Veelgestelde vragen

For retail CFD clients: leverage caps from 1:30 on major forex to 1:2 on crypto, a margin close-out when equity falls below 50% of required margin, negative-balance protection, and client money held apart from the broker's own funds. These limit the damage from leverage and broker failure. They do not protect you from losing trades.

Not one that Pepperstone names. Its Australian protection page says that on a liquidation, segregated money is handled under the Corporations Act and that not all funds may be returned. That is a real difference from Pepperstone's UK company, whose eligible clients can claim from the FSCS up to £85,000.

No. Wholesale and sophisticated clients sit outside the retail rules, so the leverage caps and the 50% close-out do not apply to them. Pepperstone gives its pros a one-time negative-balance cover of up to USD 100,000. Give up retail status only if you understand and accept that trade-off.

It means the company is licensed and supervised, and must follow ASIC's retail rules. ASIC says a licence is not an endorsement and cannot vouch for the quality of a firm's service. Check the register record, read the PDS and Target Market Determination, and test a small withdrawal before you add more money.

Not as a retail client. ASIC's order limits the broker's claim to the money in your CFD account, and Pepperstone says it will restore a negative retail balance to zero. You can still lose everything you deposited, and quickly, which is why position size matters more than any protection.
